What Do I Do If I Can’t Schedule My LL 152 Inspection on Time?

Local Law 152 has a very strict deadline. From 2020 to 2023, it was the first time anyone had required an LL 152 inspection, and its first year – 2020 – was also right in the middle of the pandemic, so the NYC DOB was a bit more forgiving as it gave people time to get used to the process.

But now it’s 2024, and those that are getting their LL 152 inspections now are the same people that received their LL 152 inspections 4 years ago (this is the first follow up year), which means that the NYC DOB is becoming more strict. There is very little indication, if any, that  the DOB will allow property owners to delay their LL 152 inspection or petition for a late one.

Local Law 152 (LL152) mandates periodic gas piping inspections for buildings in New York City, with deadlines based on community districts. If you’re unable to schedule your LL152 inspection before the deadline, it’s critical to act quickly to avoid penalties and ensure compliance. Below are steps you can take if you find yourself in this situation.

First: The Consequences of Missing the Deadline

LL 152 inspections are required, and there are strict penalties for those that are flagged for failing to complete the LL152 inspection and submit the required certification by the deadline. Missing the deadline may result in:

  • A civil penalty of up to $10,000 from the NYC Department of Buildings (DOB).
  • Increased scrutiny of your building’s gas systems.
  • Potential safety risks if issues go undetected.

It’s possible that the DOB may not file for the fine right away, but it is not a risk worth taking. Instead, make sure you do the following as soon as possible.

Steps to Take If You Can’t Schedule on Time

If you can’t seem to schedule your LL 152 inspection in time, there are a few things you can try to do, but keep in mind there are no guarantees.

  1. Request an Extension – The DOB may grant a 180-day extension under certain circumstances. To apply, complete the appropriate extension request form, provide a valid reason for the delay (e.g., unavailability of Licensed Master Plumbers or unforeseen circumstances), and submit your request before the deadline if possible.
  1. Contact Licensed Master Plumbers (LMPs) Immediately – Many LMPs experience high demand as deadlines approach, but we at Empire Plumbing still have availability. Make sure you reach out to us as soon as possible and we can see if we are able to schedule time to get to your property before the deadline.
  2. Document Your Efforts – Keep detailed records of your attempts to schedule the inspection, including communication with plumbers, extension applications, and any correspondence with the DOB. Documentation may help mitigate penalties if enforcement actions occur.
  3. Prepare for the Inspection as Soon as Possible – Ensure your building’s gas piping system is ready for inspection to avoid further delays. Address any obvious issues, such as exposed corrosion or leaks, before the LMP arrives. However, be aware that some issues should ONLY be addressed by a licensed master plumber. Do not make changes to your gas piping on your own.

It is crucial that you try to apply for the extension BEFORE the deadline. After the deadline, the NYC DOB may not allow for the extension to take place.

If you miss the deadline, it is still recommended that you schedule your LL 152 inspection ASAP. You will still need to complete it, and the sooner you complete it the more you’ll be able to appeal any penalties. It is not recommended to wait until an extension has been approved or filed. Schedule your inspection as soon as possible to give yourself the best opportunity to avoid steep penalties.

Long-Term Solutions

To avoid similar situations in the future, plan well in advance. Schedule your LL152 inspection as early as possible within your assigned calendar year. This ensures flexibility in case of scheduling conflicts or unforeseen delays.

Also, while many property owners want to avoid unnecessary expenses, remember that this is about safety. Conduct routine checks on your gas piping system to identify potential issues early. Maintain relationships with reliable Licensed Master Plumbers who are experienced in LL152 compliance, and make sure you monitor for DOB updates and resources to stay ahead of inspection cycles.

Avoiding Penalties and Ensuring Safety

Although missing the LL152 inspection deadline can lead to penalties, acting promptly and documenting your efforts can help minimize consequences. If you anticipate challenges, seek professional assistance to address compliance issues and protect the safety of your building’s occupants.
